The short version: Harvest Club is a recurring monthly membership. You can cancel at any time from inside the member portal by clicking “Cancel subscription”. By joining, you agree to let us charge your chosen payment method every month for continued access to your membership.
1. About these terms
These Terms of Service apply when you visit, purchase, access or use The Healthy Patch Harvest Club, including its website, member app, content, planning tools, libraries, downloads, support features and community areas. Harvest Club is operated by The Healthy Patch, referred to in these terms as “The Healthy Patch”, “we”, “us” or “our”.
By purchasing or using Harvest Club, you agree to these terms and our Privacy Policy. If you do not agree, do not purchase or use the service.
2. Who can join
You must be at least 18 years old and able to enter into a binding agreement, or have the permission and supervision of a parent or legal guardian. You must provide accurate account and billing information and keep it up to date.
3. Your membership and access
Your membership gives you a personal, limited, non-exclusive, non-transferable right to use Harvest Club while your membership is active. Access is for the member who purchased it. You must not share your login, sell access, make content available to non-members or use the service for commercial training without our written permission.
You are responsible for activity on your account and for keeping your password secure. Please contact us promptly if you believe somebody else has accessed your account.
4. Price, billing and renewals
Harvest Club is a recurring monthly subscription. The price, any introductory or member discount, currency, taxes and billing frequency shown at checkout form part of your purchase.
By joining, you authorise our checkout and payment providers to charge the payment method you provide on each renewal date until you cancel. If a payment fails, we or our payment provider may retry it and your access may be paused until the payment is resolved.
If you join on a locked-in promotional or existing-member rate, that rate continues while the same membership remains active, unless the checkout offer clearly says otherwise. If you cancel and later rejoin, the price available at that time may apply.
We will give reasonable advance notice of any proposed change to your recurring price. You may cancel before the new price takes effect.
5. Cancelling your membership
You can cancel at any time from inside the Harvest Club member portal. Open your subscription settings and click “Cancel subscription”. You do not need to contact us to cancel. Cancel before your next renewal date to avoid the next charge.
Cancellation takes effect at the end of your current paid billing period and you keep access until then.
6. Refunds
Harvest Club payments are non-refundable. We do not provide change-of-mind refunds, partial refunds or pro-rata refunds for unused time in a billing period.
Nothing in this section excludes, restricts or modifies any refund, remedy or other right that cannot lawfully be excluded under Australian Consumer Law.
7. What is included
Your membership may include courses, guides, downloads, planning and tracking tools, plant and pest information, seasonal content, question and image features, community access and other member resources described on the sales page or inside Harvest Club.
We may improve, replace, reorganise or retire individual features as the service develops. We will not remove the core value of an active paid membership without reasonable notice. If a change materially reduces the service you purchased, you may contact us so we can offer an appropriate remedy where required by law.
8. Your garden information and uploads
You keep ownership of garden plans, notes, photos, recordings, questions and other material you submit. You give us a limited licence to host, copy, process and display that material as needed to operate, secure, support and improve Harvest Club.
You confirm that you have the right to upload your material and that it does not violate another person’s privacy, intellectual property or other rights. Please avoid uploading faces, addresses, documents or other personal information that is not needed for your gardening question.
We may use garden and harvest photos or stories you share with Harvest Club in The Healthy Patch marketing and promotional material. You can opt out at any time by emailing hello@thehealthypatch.com.au, and we will stop using your material in new marketing within a reasonable time. We will not publish your full name, contact details or material that clearly identifies another person without appropriate permission.
9. Community standards
If you use a Harvest Club community area, you agree to be respectful and constructive. You must not post unlawful, threatening, abusive, discriminatory, deceptive or infringing content, spam other members, collect their personal information, or use the community to sell unrelated products or services.
We may moderate or remove content and restrict community access where reasonably necessary to protect members or operate the community.
10. Gardening, food and safety information
Harvest Club provides general educational gardening information. Results vary with climate, soil, water, plant variety, pests, weather and individual circumstances. Information generated or suggested in any part of Harvest Club may be incomplete or incorrect, so use your judgement and check important decisions.
Harvest Club is not medical, veterinary, nutritional, chemical, legal or other professional advice. Always:
- check local conditions, biosecurity rules and council requirements;
- follow product labels and safety directions for fertilisers, sprays and garden products;
- correctly identify a plant before eating or using it;
- consider allergies, pets, children and plant toxicity; and
- seek advice from an appropriately qualified professional where health or safety is involved.
11. Our content and intellectual property
Harvest Club and its content, branding, designs, software, videos, written material, downloads and teaching methods are owned by or licensed to The Healthy Patch and are protected by intellectual property laws.
You may view, use and download member resources for your own household’s personal, non-commercial use. You must not copy, publish, sell, sublicense, scrape, reverse engineer, train an automated system on, or create a competing product from our content without written permission.
12. Third-party services
Harvest Club relies on third-party services for checkout, payment processing, hosting, login, storage, email, community features and some interactive garden features. Those services may have their own terms and privacy policies. We are not responsible for a separate third-party service that you choose to use, but we remain responsible for our obligations under applicable law.
13. Availability, maintenance and your records
We work to keep Harvest Club available and secure, but uninterrupted access cannot be guaranteed. Maintenance, updates, internet outages, provider failures and events outside our reasonable control may occasionally affect access.
Please keep your own copy of any garden record or upload that would be difficult to replace. We may provide export tools where available, but Harvest Club is not intended to be your only permanent backup.
14. Suspending or ending access
We may suspend or end access if you do not pay, seriously or repeatedly breach these terms, misuse the service, create a safety or security risk, or act unlawfully. Where practical, we will explain the problem and give you a reasonable opportunity to fix it first.
You may end these terms by cancelling your membership and stopping use of the service. Provisions about intellectual property, liability, disputes and any accrued payment obligations continue after the membership ends.
15. Australian Consumer Law and liability
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including your rights under the Australian Consumer Law.
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data, crop loss or garden damage arising from your use of general gardening information. Where the law allows us to limit a remedy for a service, our liability may be limited to supplying the service again or paying the reasonable cost of having it supplied again.
16. Questions, complaints and disputes
Please email hello@thehealthypatch.com.au if you have a question or complaint. Include your name, account email and a clear description of the issue. We will review it and try to resolve it fairly.
Before starting formal proceedings, both sides agree to make a genuine attempt to resolve the dispute directly, except where urgent relief or a consumer regulator process is appropriate.
17. Changes to these terms
We may update these terms when Harvest Club changes or when legal requirements change. The current version and its update date will be published on this page. If a change materially affects an active paid membership, we will provide reasonable notice before it takes effect.
18. Governing law
These terms are governed by the laws of Victoria, Australia. You and The Healthy Patch submit to the courts of Victoria and any courts that may hear appeals from them, subject to any rights you have to bring a claim elsewhere under consumer law.
