The short version: we collect the information needed to run your membership and make the garden tools useful for your patch. We do not sell your personal information. We may use garden and harvest photos or stories you share in The Healthy Patch marketing, and you can opt out at any time by emailing us.
1. About this policy
This Privacy Policy explains how The Healthy Patch collects, holds, uses and discloses personal information connected with The Healthy Patch Harvest Club. It covers the sales page, checkout, member app, garden tools, downloads, support, emails and community features that we operate.
For privacy questions, access or correction requests, complaints or account deletion requests, email hello@thehealthypatch.com.au.
2. The information we collect
Account and membership information
This may include your name, email address, login details, country or region, membership status, purchase history, discount eligibility and communication preferences.
Payment information
Our checkout and payment providers collect the card or payment details needed to process your purchase. We receive information such as the amount, currency, transaction status, renewal status and limited billing details. We do not receive or store your full card number.
Your garden information
Depending on the tools you use, this may include your location or growing region, climate information, patch dimensions, garden plans, plant choices, planting dates, journal entries, harvest records, notes, goals, preferences and answers to garden questions.
Photos, recordings and other uploads
If you choose to upload a plant or pest photo, harvest photo, voice note, story, document or other file, we collect the material and information needed to process your request. Photos may contain metadata or background details. Please avoid including people, house numbers, addresses or other personal information that is not needed.
Support and communications
We collect information you provide when you email us, submit a support request, answer a survey, join a promotion or communicate with us through another channel.
Technical and usage information
We and our service providers may collect your IP address, browser and device type, operating system, pages and features used, dates and times, referral source, cookie identifiers, login records, error reports, security events and performance information.
3. How we collect information
We collect information:
- directly from you when you purchase, create an account, use a tool, upload material or contact us;
- automatically through cookies, logs and similar technologies when you use our websites or app;
- from checkout, payment, login, email and support providers that help us run your membership;
- from The Healthy Patch records where needed to confirm an existing-member offer or restore access; and
- from public or third-party sources when you ask a feature to use that information, such as location-based climate or growing information.
If you do not provide information that is required for an account, payment or requested feature, we may not be able to provide that part of Harvest Club.
4. Why we use your information
We use personal information to:
- process purchases, manage renewals, confirm membership and provide account access;
- save and display your garden plans, records, preferences and uploads;
- personalise seasonal information and garden recommendations for your location and patch;
- answer gardening questions and process plant or pest images;
- send service messages, login or password emails, renewal information and support replies;
- send marketing where you have consented or where the law permits, with an unsubscribe option;
- use garden and harvest photos or stories you share in The Healthy Patch marketing and promotional material, unless you opt out;
- operate, test, troubleshoot, secure and improve Harvest Club;
- detect fraud, misuse, security threats and technical faults;
- meet legal, accounting, tax and regulatory obligations; and
- create aggregated or de-identified insights that do not reasonably identify individual members.
5. Garden-assistance features
Some Harvest Club features use specialist technology to help answer questions, interpret photos, suggest companion plants, prepare garden plans or create harvest insights. Information you submit to one of these features may be sent to a technology service provider for processing and returned to Harvest Club as an answer or suggestion.
We use business-grade provider settings where available and send only the information needed for the feature. Do not submit information about another person or sensitive personal information to a garden tool.
Suggestions from these features are not used to make legal, financial, employment or other decisions that have a significant effect on you.
6. When we share information
We do not sell personal information. We may disclose information to:
- checkout and payment providers, including SamCart and its payment partners;
- hosting, database, authentication and file-storage providers, including Vercel and Supabase;
- specialist technology and data-processing providers when you use a relevant feature;
- email, support, analytics, monitoring and security providers that help us operate the service;
- Meta if you choose to participate in a Facebook community, which is also subject to Meta’s privacy policy;
- professional advisers such as accountants, lawyers, insurers and IT or security consultants;
- a purchaser or successor if our business or relevant assets are reorganised or transferred, subject to appropriate confidentiality and privacy protections;
- regulators, courts, law enforcement or other parties where required or authorised by law; and
- another party where you have asked us to share it or given consent.
Service providers are permitted to use information only for the service they provide to us or as otherwise allowed by law.
7. Overseas processing and disclosure
Some service providers store or process information outside Australia, including in the United States, the European Union and other countries where their systems or support teams operate. The exact locations can change as providers update their infrastructure.
Where Australian privacy law applies to an overseas disclosure, we take reasonable steps to use reputable providers, appropriate contracts, access controls and other safeguards. Overseas privacy laws may differ from Australian law.
8. Cookies and similar technologies
We use cookies and similar technologies to keep you signed in, remember settings, process checkout journeys, understand site and feature use, measure performance and protect accounts. Some cookies are necessary for the service to work.
You can manage cookies through your browser. Blocking necessary cookies may stop login, checkout or other features from working properly.
9. Marketing and promotional use
We may use garden and harvest photos or stories you share with Harvest Club or its community in The Healthy Patch marketing and promotional material. You can opt out at any time by emailing hello@thehealthypatch.com.au. We will stop using your material in new marketing within a reasonable time and will not publish your full name, contact details or material that clearly identifies another person without appropriate permission.
We may send updates, offers and gardening content where you have subscribed or where applicable law allows it. You can unsubscribe from marketing using the link in an email or by contacting us. We may still send essential account, billing, security and service messages.
10. Security
We use reasonable technical and organisational measures designed to protect personal information from loss, misuse, interference and unauthorised access, modification or disclosure. Measures may include encrypted connections, account authentication, access restrictions, private storage controls, monitoring, backups and provider security reviews.
No online system can be guaranteed to be completely secure. Please use a strong, unique password and contact us promptly if you suspect unauthorised account access. If an eligible data breach occurs, we will assess and respond to it, including notifying affected people and the Office of the Australian Information Commissioner where required.
11. How long we keep information
We keep personal information for as long as needed to provide Harvest Club, maintain business and legal records, resolve disputes, prevent fraud and meet legal obligations. Retention periods vary according to the type of information.
When information is no longer required, we take reasonable steps to delete it or de-identify it, subject to backups and any legal retention requirement. Deletion from backups may occur through the normal backup cycle.
12. Access, correction and account deletion
You may request access to personal information we hold about you, ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading, or request deletion of your account and eligible information.
Email hello@thehealthypatch.com.au from your account email. We may need to verify your identity. We will respond within a reasonable period and explain any lawful reason we cannot complete part of a request. Some transaction, tax, fraud-prevention or dispute records may need to be retained after account deletion.
13. Children’s privacy
Harvest Club memberships are intended for adults. A child may use garden activities with a parent or guardian’s supervision, but should not create an account, make a purchase or submit personal information independently. Contact us if you believe a child has provided personal information without appropriate permission.
14. Privacy complaints
Send a privacy complaint to hello@thehealthypatch.com.au and include enough information for us to understand and investigate the issue. We will acknowledge the complaint and aim to respond within a reasonable period.
If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner.
15. Changes to this policy
We may update this policy when our services, providers or legal obligations change. The current version and its update date will be published on this page. We will provide additional notice if a change materially affects how we handle existing member information.
